Preamble: The online store www.vignoblesetvinspicard.fr is published by VIGNOBLES ET VINS PICARD, a public limited company with a capital of €200,000, registered with the Dijon Trade and Companies Register under number 480 127 950, whose registered office is located at 5 Rue du Château – 21190 CHASSAGNE-MONTRACHET. VAT number: FR 16480127950 – APE code: 4634Z.

Article 1 – Entirety

These terms and conditions constitute the entire agreement between the parties. By placing an order on the online store at famillepicard.fr, the customer is deemed to have accepted them without reservation. These terms and conditions apply to the exclusion of all other terms and conditions, including those applicable to sales in stores or through other distribution and marketing channels. They are accessible on the famillepicard.fr website and shall prevail, where applicable, over any other version or contradictory document. These terms and conditions may only be waived by the express written agreement of VIGNOBLES ET VINS PICARD. VIGNOBLES ET VINS PICARD and the customer agree that these terms and conditions exclusively govern their relationship. VIGNOBLES ET VINS PICARD reserves the right to modify these terms and conditions from time to time. Any changes will be applicable as soon as they are published online.
If a sales condition were to be lacking, it would be considered to be governed by the practices in force in the distance selling sector whose companies are headquartered in France.


Article 2 – Content

These general terms and conditions define the rights and obligations of the parties in the context of the online sale of products offered to the customer in the catalogue of the online store on the website famillepicard.fr

These conditions only apply to purchases made by customers located in France and delivered exclusively within metropolitan France (excluding overseas territories).

Article 3 - Pre-contractual information

3.1 The customer acknowledges having received, prior to placing his order and concluding the contract, in a legible and understandable manner, these general terms and conditions of sale and the essential characteristics of each product, its price, the amount of delivery costs, the delivery methods and all other possible costs.

3.2 Excessive alcohol consumption is dangerous to your health and should be consumed in moderation. In accordance with the Public Health Code, the sale of alcohol to minors under eighteen years of age is prohibited. The customer confirms that they are at least eighteen years old on the date of placing the order. For your health, avoid eating too much fat, sugar, or salt.

Article 4 - Order

The customer can place their order online, using the online catalog and the order form provided, for any product, subject to availability. In the event of a stock shortage or unavailability of an ordered product, the support team at VIGNOBLES ET VINS PICARD will inform the customer within a maximum of five business days of receiving the order, by mail or email, potentially offering the customer a product of equivalent quality and price, or failing that, a refund will be issued within a maximum of 14 days, without the customer being entitled to any compensation or damages.
For the order to be validated, the customer must accept these terms and conditions by clicking in the designated area. They must also complete their contact details, choose the delivery and billing addresses, and finally confirm the payment method.
The sale will be considered final:
- after VIGNOBLES ET VINS PICARD sends the customer confirmation of acceptance of the order by email;
- and after VIGNOBLES ET VINS PICARD has received the full price.
All orders imply acceptance of the prices and descriptions of the products available for sale.
In certain cases, particularly quantities ordered that are clearly excessive compared to the quantities usually ordered by customers as consumers, non-payment, incorrect address or other problem on the customer's account, VIGNOBLES ET VINS PICARD reserves the right to block the customer's order until the problem is resolved.

The partial or total cancellation of the product order and their possible refund will then be carried out; if applicable, the remainder of the order will remain firm and final.

Article 5 - Electronic Signature

Providing the customer's bank card number online and the final validation of the order will constitute proof of the customer's agreement:
- payment of sums due under the purchase order,
- signature and express acceptance of all transactions carried out.
In the event of fraudulent use of the bank card, the customer is invited, as soon as this use is noticed, to contact VIGNOBLES ET VINS PICARD, on the following telephone number: 33 (0) 3 80 21 98 57 or by email at the following address: contact@domainesfamillepicard.com from Monday to Friday from 9am to 12pm and from 2pm to 5pm.

Article 6 - Order Confirmation

After validation of the order and payment of the price thereof by the customer on the website famillepicard.fr, the order is final and the sale is deemed to have been formed, so that the order can no longer be subject to any cancellation or modification, without the prior written agreement of VIGNOBLES ET VINS PICARD, subject to the exercise by the customer of his right of withdrawal described in article 16 hereof.

Article 7 - Proof of the transaction

The computerized records, stored in the VIGNOBLES ET VINS PICARD computer systems under reasonable security conditions, will be considered proof of communications, orders, and payments between the parties. Order forms and invoices are archived on a reliable and durable medium that can be produced as evidence.

Article 8 - Product Information

The products governed by these terms and conditions are those listed in the online store on the famillepicard.fr website and indicated as sold and shipped by VIGNOBLES ET VINS PICARD. They are offered subject to availability. The products are described and presented as accurately as possible. However, if any errors or omissions occur in this presentation, VIGNOBLES ET VINS PICARD cannot be held liable. Product photographs are for illustrative purposes only and are not contractual. They may be modified at any time by VIGNOBLES ET VINS PICARD.

VIGNOBLES ET VINS PICARD reserves the right to correct any material, accidental or omission errors in these general terms and conditions of sale, as well as in any other contractual document.

Article 9 – Price

VIGNOBLES ET VINS PICARD reserves the right to modify its prices at any time but undertakes to apply the prices in effect at the time of the order, subject to availability on that date. Prices are indicated in euros. They include delivery within mainland France for a minimum order of 6 bottles. Prices include VAT applicable on the day of the order, and any change in the applicable VAT rate will be automatically reflected in the price of products in the online store. Payment of the full price must be made at the time of ordering. Under no circumstances may the sums paid be considered as a deposit or down payment.


Promotional offers:
The VIGNOBLES ET VINS PICARD shop may occasionally carry out promotional operations on some of the products available in the site's catalogue and/or offer its loyal customers exclusive deals.

Sponsorship:
The VIGNOBLES ET VINS PICARD online store may offer a referral program allowing customers who have already placed at least one order with VIGNOBLES ET VINS PICARD to refer friends. The referred friend will then receive a discount voucher to use on their first order on the website www.famillepicard.fr. The referrer's discount vouchers will be valid for six months from the date of issue.


Article 10 - Payment Method

This is a binding order, meaning that placing the order implies payment by the customer. Payment for the ordered products is made directly on the famillepicard.fr website by credit card at the time of order placement. VIGNOBLES ET VINS PICARD reserves the right to suspend order processing and delivery in the event of a payment authorization refusal by officially accredited organizations or in the event of non-payment, regardless of the payment method. VIGNOBLES ET VINS PICARD also reserves the right to refuse to make a delivery or fulfill an order from a customer who has not fully or partially paid for a previous or current order, without the customer being able to claim damages or compensation. VIGNOBLES ET VINS PICARD has implemented an order verification procedure to ensure that no one uses another person's bank details without their knowledge. As part of this verification process, the customer may be asked to send VIGNOBLES ET VINS PICARD a copy of their identification and proof of address by fax, email, or postal mail. The order will only be validated after VIGNOBLES ET VINS PICARD has received and verified the documents sent.
To ensure the security of online payments by bank card, VIGNOBLES ET VINS PICARD has adopted the SSL encryption process to protect as effectively as possible all data related to the means of payment used by the customer.
This system ensures the confidentiality of information transmitted to the familypicard.fr website, as the data is encrypted by software that prevents any reading during its transmission over the network.
The invoice for the products ordered will be sent to the customer with the delivery of the products or by email.
Payments made by the customer will only be considered final after actual receipt of the sums due by VIGNOBLES ET VINS PICARD.


Article 11 Delivery – Resolution – Refund

The delivery times indicated below apply, unless otherwise stipulated, to products delivered by VIGNOBLES ET VINS PICARD, or by a carrier mandated by it, or by post, to the address appearing in the order.
Except in cases of force majeure or during periods when the online store is closed, which will be clearly announced on the website's homepage, shipping times will be, subject to stock availability, as indicated below. Shipping times begin from the order registration date shown on the order confirmation email.
For deliveries in Metropolitan France (excluding overseas territories) and the other countries mentioned in Article 12 on Delivery Terms, the delivery time is 15 working days from the day after VIGNOBLES ET VINS PICARD accepted the customer's order.

Delivery is defined as the transfer of physical possession or control of the products to the customer. It is only made after confirmation of payment by VIGNOBLES ET VINS PICARD's bank.

If VIGNOBLES ET VINS PICARD is unable to deliver the ordered products within the 15-day period specified above, and if the delivery delay exceeds 15 working days and is not due to a case of force majeure, then the customer may terminate the sales contract by right.

In this case, the customer must inform VIGNOBLES ET VINS PICARD by mail or email, who will then undertake to reimburse the customer, as soon as possible and in any event within 14 working days from receipt of the cancellation request, all sums that VIGNOBLES ET VINS PICARD may have received when placing the order.


Article 12 Delivery methods

Products are delivered to the address provided by the customer on the order form; the customer is responsible for ensuring its accuracy. Any package returned to VIGNBOLES ET VINS PICARD due to an incorrect or incomplete delivery address will either be reshipped at the customer's expense or refunded, less the initial shipping costs. Upon request, the customer can have the invoice sent to the billing address instead of the delivery address by selecting the corresponding option on the order form.
If the customer is absent on the day of delivery, the delivery person will leave a delivery notice in the mailbox, which will allow the package to be collected at the location and during the time period indicated.

If, upon delivery, the original packaging is damaged, torn, or open, the customer must check the condition of the items. If they are damaged, the customer must refuse the package and note this on the delivery slip (package refused because it was open or damaged).
The customer must indicate on the delivery note, in the form of handwritten reservations accompanied by their signature, any anomaly concerning the delivery (damage, missing product compared to the delivery note, damaged package, broken products...).
This verification is considered to have been carried out once the customer, or a person authorized by him, has signed the delivery note.
The customer must then confirm these reservations to the carrier by registered mail no later than two working days following receipt of the item(s) and send a copy of this letter by fax or regular mail to the seller at the address indicated in the legal notices of the site.
If products need to be returned to VIGNOBLES ET VINS PICARD, a return request must be submitted to VIGNOBLES ET VINS PICARD within 7 days of delivery. Any claim made after this period will not be accepted. Product returns will only be accepted for products in their original packaging.

No deliveries will be made to tourist accommodations that do not constitute the customer's main residence (such as campsites, hotels, etc.), poste restante, post office boxes or any other place that does not constitute a usual residence of the customer.


Delivery is handled via Chronopost for all orders up to 12 bottles of 75cl. For orders exceeding this limit, delivery will be handled by one of our partner carriers.
The delivery will be left at the main entrance (building or house entrance) of the delivery address indicated in the order confirmation. The delivery driver will not perform any additional handling (for example: unloading boxes, transferring boxes into an elevator, room, or between floors of a building).

Delivery charges:

The prices shown are free of charge for a minimum order of 6 bottles and for delivery in Metropolitan France (excluding Corsica and overseas territories).
Additional fees will apply, subject to the conditions below:
1) For orders of fewer than 6 bottles with delivery in Metropolitan France: €15 including VAT per order
2) For an order with delivery to Corsica: 30 euros including VAT per order.

Article 13 - Delivery Errors

The customer must notify the seller of any delivery errors and/or non-conformity of the products in terms of type or quantity compared to the order form, either on the day of delivery or at the latest on the first business day following delivery. Any claim made after this period will be rejected.
The complaint can be made, at the customer's choice, by telephone at the following number: 33 (0) 3 80 21 98 57 or by email at the following address: contact@domainesfamillepicard.com from Monday to Friday from 9am to 12pm and from 2pm to 5pm.
Any claim not made in accordance with the rules defined above and within the specified time limits will not be taken into account and will release VIGNBOLES ET VINS PICARD from any liability towards the customer.
Upon receipt of the claim, VIGNOBLES ET VINS PICARD will assign an exchange number to the product(s) in question and communicate it to the customer by email. A product exchange can only take place after the exchange number has been assigned. Return shipping costs are covered by VIGNOBLES ET VINS PICARD.

Article 14 - Transfer of Risks

Products sold by VIGNOBLES ET VINS PICARD travel at its own risk and peril, the transfer of risks and responsibilities taking place upon delivery of the products to the address indicated by the customer in the order.


Article 15 - Product Warranty

Given the nature of the products sold, VIGNOBLES ET VINS PICARD recommends that the customer store them in a place that allows for good preservation, in particular in a cool and humid place, away from light, sun, frost and rain and without sudden temperature changes.

VIGNOBLES ET VINS PICARD cannot be held liable for damages of any kind, whether material, immaterial or bodily, which may result from poor manufacturing or use of the products sold.

Article 16 - Right of withdrawal

In accordance with the provisions of the Consumer Code, the customer has a period of 14 working days from the date of delivery of his order, to return any item which does not suit him and request an exchange or refund without penalty, with the exception of the return costs which remain the responsibility of the customer.
However, the products must be returned in their original packaging and in perfect condition for resale within 14 days of notification to VIGNOBLES ET VINS PICARD of the customer's decision to withdraw, accompanied by the purchase invoice.
Any product that has been damaged or partially consumed will not be eligible for the right of withdrawal provided for in this article.
To exercise the right of withdrawal, the customer must notify VIGNOBLES ET VINS PICARD of their decision to withdraw from the order by means of an unambiguous statement (for example, a letter sent by post, fax or email) or use the model withdrawal form presented below, which is given as an example and is not mandatory.

If the customer wishes to return only part of their order, they must specify the list of products concerned.

If the right of withdrawal is exercised within the aforementioned period, the price of the purchased product(s) will be refunded as soon as possible and no later than 14 days following the date of receipt of the returned product(s) at the premises of VIGNOBLES ET VINS PICARD, or the date on which the customer provided VIGNOBLES ET VINS PICARD with proof of shipment of these products. Return shipping costs remain the responsibility of the customer.
Products must be returned undamaged, in new condition, and in their original packaging.

Article 17 - Force majeure

Any circumstances independent, external and unforeseeable to the will of the parties preventing the performance under normal conditions of their obligations shall be considered as causes of exemption from the obligations of the parties and shall result in their suspension.
The party invoking the circumstances referred to above must immediately notify the other party of their occurrence, as well as their disappearance.
Force majeure shall be defined as any irresistible event or circumstance beyond the control of the parties, unforeseeable, unavoidable, and independent of their will, which cannot be prevented by them despite all reasonable efforts. Specifically, the following shall be considered force majeure or fortuitous events, in addition to those typically recognized by French courts: blockages of transportation or supply routes, earthquakes, fires, storms, floods, lightning, pandemics, epidemics, telecommunications network outages, or difficulties specific to telecommunications networks external to the client.
The parties will consult to examine the impact of the event and agree on the conditions under which the contract will continue to be performed. If the force majeure event lasts for more than three months, these terms and conditions may be terminated by the affected party.

Article 18 - Intellectual Property

The content of the website (technical documents, drawings, photographs, etc.) remains the property of VIGNOBLES ET VINS PICARD, the sole holder of intellectual property rights over this content.
Customers agree not to make any use of this content; any total or partial reproduction of this content is strictly prohibited and may constitute an infringement.

Article 19 - Data Processing and Freedoms

The personal data provided by the customer is necessary for processing their order and issuing invoices.
They may be communicated to the seller's partners responsible for the execution, processing, management and payment of orders.
In accordance with the provisions of the General Data Protection Regulation (“GDPR”) and Law No. 2018-493 of June 20, 2018, the customer has the right to access, modify, rectify, object to and delete personal data concerning him/her that is processed by the seller.

Article 20 – Miscellaneous Provisions

Partial invalidation
If one or more provisions of these general terms and conditions are held to be invalid or declared as such pursuant to a law, regulation or final decision of a competent court, the other provisions shall remain in full force and effect.

Non-waiver
The failure of either party to enforce any right or provision of these terms and conditions shall not be deemed a waiver of such right or provision.

Title
In case of any difficulty of interpretation between any of the headings appearing at the beginning of the clauses, and any of the clauses themselves, the headings shall be declared non-existent.

Article 21 – Mediation – competent jurisdiction

The customer may resort to conventional mediation, in particular with the Consumer Mediation Commission or with existing sectoral mediation bodies, or to any alternative dispute resolution method (conciliation, for example) in the event of a dispute.
If an amicable solution cannot be found, only the French courts will have jurisdiction.

Article 22 - Applicable Law

These terms and conditions are governed by French law, excluding the provisions of the Vienna Convention. This applies to both substantive and procedural rules. In the event of a dispute or complaint, the customer should first contact VIGNOBLES ET VINS PICARD to seek an amicable solution.
